Terms of Service

Welcome to Poker Panel. These Terms of Service ("Terms") govern your use of the Poker Panel macOS application, the Poker Panel Camera iOS application, the pokerpanel.app website, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

Poker Panel is operated by Henry Schlesinger, sole proprietor ("Poker Panel," "we," "our," or "us").

1. Eligibility

You must be at least 18 years of age to use the Service. Poker Panel is poker-related software designed for adult users. By creating an account or using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Account and License

• When you subscribe to Poker Panel, you receive a personal, non-exclusive, non-transferable, revocable license to use the software.
• Your license is per-user. You may not share, sublicense, or transfer your license key or account credentials to any other person.
• Each license key may only be active on one device at a time. If you need to switch devices, you must deactivate the license on the current device before activating it on a new one.

3. Subscription Plans and Billing

• Standard Plan: $59 per month
• Pro Plan: $149 per month

Subscriptions are billed monthly through Stripe, our payment processor. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel. You can cancel your subscription at any time; your access will continue until the end of the current billing period.

Prices are subject to change with 30 days' notice. Any price changes will not affect your current billing period.

4. Refund Policy

We offer a full refund within 14 days of your initial purchase, no questions asked. To request a refund, contact us at [email protected]. Refunds are processed back to your original payment method via Stripe and may take 5–10 business days to appear on your statement.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the software
• Modify, adapt, translate, or create derivative works based on the software
• Share, resell, redistribute, sublicense, or otherwise transfer your license to any third party
• Circumvent, disable, or interfere with any license verification or security features of the software
• Use the Service to facilitate any form of illegal gambling
• Use automated tools to access or interact with the Service in an unauthorized manner

6. License Revocation

We reserve the right to suspend or revoke your license at any time if you violate these Terms, including but not limited to: sharing your license key, using the software on multiple devices simultaneously, circumventing license verification, or engaging in any prohibited activity. In the event of revocation for cause, you will not be entitled to a refund for the current billing period.

7. Intellectual Property

The Service, including the Poker Panel software, CardEYE vision model, all graphics, logos, trademarks, and content, is the exclusive property of Poker Panel and is protected by applicable intellectual property laws. Your subscription grants you a limited license to use the software - it does not transfer any ownership rights to you.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that:

• The software will meet your specific requirements or expectations
• The software will operate without interruption, errors, or defects
• Card detection results will be 100% accurate at all times
• The software will produce any specific results, including streaming quality, viewer engagement, or other outcomes

9. Limitation of Liability

To the maximum extent permitted by law, Poker Panel and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Service, regardless of the cause of action or the theory of liability.

Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid to us in the three (3) months preceding the event giving rise to the claim.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.

11. Third-Party Services

The Service integrates with third-party services including Stripe (payment processing), Apple (app distribution), and Google Cloud Platform (infrastructure). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.

12. Modifications to the Service

We reserve the right to modify, update, or discontinue the Service (or any part thereof) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of the Service.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the application. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under or in connection with these Terms shall be resolved in the appropriate courts within the United States.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
